MarketFlowUpThese Terms of Service ("Terms") govern your access to and use of MarketFlowUp (the "Service"), operated by MarketFlowUp ("we", "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The service
MarketFlowUp is an AI marketing platform that helps you generate ad copy, images and videos, personalize them to your brand, save them to your Library, and publish them by email or to social and advertising accounts you choose to connect.
2. Your account
You must provide accurate information, keep your credentials secure, and are responsible for all activity under your account. You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service.
3. Acceptable use
You agree not to use the Service to create or distribute content that is illegal, infringing, deceptive, hateful, harassing, sexually explicit involving minors, spam, or malware. When you connect a third-party platform (such as TikTok, Instagram, Facebook, LinkedIn, YouTube, X or Google), you must comply with that platform's own terms, policies and community guidelines. You are solely responsible for the content you publish.
4. AI-generated content
The Service uses artificial intelligence to generate text, images and video from your prompts. AI output can be inaccurate, biased or resemble existing works. You are responsible for reviewing, editing and verifying any output before you use or publish it, and for ensuring it is truthful and compliant with applicable laws and advertising standards. As between you and us, and to the extent permitted by law, you own the content you generate and are responsible for it.
5. Connected accounts and publishing
If you connect a third-party account, you authorize us to act within the permissions (scopes) you grant — for example, to post content on your behalf. Access tokens are stored securely and used only to provide the features you request. You can disconnect any account at any time. We are not responsible for the availability, rules or decisions of third-party platforms.
6. Plans, billing and cancellation
We offer free and paid plans. Paid plans are billed in advance according to the plan you choose on our pricing page, plus any applicable taxes. You can cancel at any time; cancellation stops future renewals. Except where required by law, fees already paid are non-refundable.
7. Intellectual property
The Service, including its software, design, and the MarketFlowUp name and logo, is owned by us and protected by law. These Terms grant you no rights in our intellectual property other than to use the Service as permitted.
8. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI output will meet your requirements.
9. Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special or consequential damages, or for lost profits, data or goodwill, arising from your use of the Service. Our total liability for any claim will not exceed the amount you paid us in the twelve months before the claim.
10. Termination
We may suspend or terminate your access if you breach these Terms. You may stop using the Service and delete your account at any time from your dashboard.
11. Changes
We may update these Terms from time to time. Material changes will be reflected by the "Last updated" date above. Your continued use of the Service after changes take effect constitutes acceptance.
